Terms of Service
Effective date: 11 October 2026
These Terms of Service ("Terms") govern your use of the Ficious, Ficious Care, and related apps and services (the "Services"). By using the Services, you agree to these Terms.
1. Using the Services
These Terms apply to the Ficious apps, websites, Ficious Care, connected-device features, and related services (the Services). By accessing or using a Service, you agree to these Terms. You must be legally able to agree to them; if you use a Service on behalf of an organization, you confirm that you can bind it.
2. Your account
Provide accurate information, keep your credentials secure, and promptly notify us if you suspect unauthorized access. You are responsible for activity under your account to the extent permitted by law. We may require verification to protect your account.
3. Content and marketplace listings
You retain your rights in content you submit. You grant Ficious a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content only as reasonably necessary to operate, secure, and promote the Services and the features you choose to use. You confirm that you have the rights and permissions needed to submit it. Public content may be seen by other users.
4. Prohibited conduct
- Break applicable law, infringe another person's rights, or trade in prohibited goods or wildlife.
- Harass, threaten, impersonate, defraud, spam, or publish another person's private information without authority.
- Upload malware, probe or disrupt systems, bypass access controls, or misuse another user's account or data.
- Submit misleading listings, manipulate reviews or handoff confirmations, or use the Services to facilitate unsafe or unlawful transactions.
- Use automated means to access or collect information from the Services except as expressly permitted.
5. Termination
We may remove content, restrict a feature, or suspend or close an account when reasonably necessary to enforce these Terms, address safety or security risks, comply with law, or protect users and the Services. Where appropriate and legally permitted, we will provide notice and an opportunity to contact support. You may stop using the Services at any time.
6. Disclaimers and limitation of liability
To the extent permitted by applicable law, the Services are provided as available and without warranties not expressly stated in these Terms. Aquarium information, care suggestions, sensor readings, and automated actions are informational aids only; they may be incomplete, delayed, or inaccurate and are not veterinary, professional, or emergency advice. You remain responsible for monitoring your aquarium and animals. Nothing in these Terms excludes rights or liability that applicable law does not allow us to exclude.
7. Governing law
Applicable law governs these Terms. Any dispute will be handled by a competent authority or court under the applicable procedural rules. Nothing in this section limits mandatory consumer or privacy rights available where you live.
8. Contact us
Questions about these Terms can be sent to [email protected].
9. Third-party services and availability
Some features rely on networks, devices, or services operated by others and may be unavailable or change over time. Their own terms and privacy notices may apply. We may modify, suspend, or discontinue a feature for operational, safety, or legal reasons; where required, we will give notice.
10. Intellectual property
Ficious and its licensors retain rights in the Services, software, design, and brand assets, excluding content users own. These Terms give you a limited, revocable, non-transferable right to use the Services for their intended purpose. You may not copy, modify, or commercially exploit our materials except as allowed by law or with permission.
11. Changes to these Terms
We may update these Terms as the Services or applicable requirements change. We will revise the effective date and provide notice or seek consent when required. Continued use after the effective date means acceptance only to the extent permitted by applicable law.
12. Other terms
If a provision is unenforceable, the rest remains effective to the extent allowed by law. A failure to enforce a provision is not a waiver. These Terms and any feature-specific terms presented to you form the agreement for your use of the Services.
